FRESNO – A Clovis restaurant is alleged to have failed to pay a former cook the appropriate rate for overtime and minimum wages.
Xiujian Zhang filed a complaint on May 24 in the Fresno County Superior Court against Zhi Xing Li; LZX Inc., doing business as Four Seasons Chinese Restaurant; and Does 1-25 citing California labor codes.
According to the complaint, the plaintiff was employed by the defendants as a cook from October 2015 to May 2018. The plaintiff alleges the defendants failed to pay overtime wages and paid an hourly rate below the minimum wage.
The plaintiff holds Li, LZX Inc. and Does 1-25 responsible because the defendants allegedly failed to provide accurate itemized wage statements and maintain records of hours worked, failed to provide mandatory rest and meal break periods, and failed to compensate its employees with overtime and a minimum wage.
The plaintiff seeks judgment against all defendants for compensatory, liquidated and applicable damages; unpaid penalty wages; civil penalties; interest; restoration of money; injunctive relief; attorney’s fees and costs; and further relief as the court deems just.
