FRESNO – Siblings of a man who was struck by a tractor-trailer and later died of his injuries have filed a wrongful death suit against the driver and his employer.
Teresa Rangel, Amelia Torrez Galvan, Maria Leticia Torres Galvan and Jose Torres Galvan filed a complaint on May 22 in the Fresno County Superior Court against D & I Farms Inc., Javier Bautista Sierra and Does 1-20 alleging wrongful death and negligence.
According to the complaint, the plaintiffs allege that on Sept. 11, 2017, Javier Torrez Galvan was walking on the side of the road near the intersection of Mountain View and Van Horn avenues when he was struck by a tractor-trailer operated by defendant Sierra during the course and scope of his work duties for D & I Farms. The suit states Sierra's windshield was fogged up and that he left the scene. The suit states Javier Torrez Galvan later died.
The plaintiffs hold D & I Farms Inc., Sierra and Does 1-20 responsible because Sierra carelessly and negligently operated the tractor-trailer to cause it to collide and kill their decedent.
The plaintiffs request a trial by jury and seek judgment against defendants, award non-economic damages, funeral and burial expenses, interest, and further relief as the court may deem just. They are represented by Martin Taleisnik and Corina Burchfield of Sawl Law Group in Fresno.
