Man alleges hole at Belmont Memorial Park caused fall

FRESNO – A man alleges he was injured at a Fresno cemetery after falling because of a hole.

Gayland R. Hilton filed a complaint on June 11 in the Fresno County Superior Court against Belmont Memorial Park Corp. of California and Does 1 to 25 alleging negligence and premises liability.

According to the complaint, the plaintiff alleges that on March 28, he was at the graveyard owned and operated by defendant where his mother was buried when he stepped into a hole in the ground near his mother's grave and fell. 

As a direct proximate result, Hilton claims he sustained bodily injuries, including medical expenses, pain and suffering, emotional distress and other damages according to proof. 

The plaintiff holds Belmont Memorial Park Corp. of California and Does 1 to 25 responsible because the defendant allegedly negligently created, maintained and/or failed to inspect the premises.

The plaintiff requests a trial by jury and seeks judgment for compensatory damages according to proof, plus costs of suit, and for such relief as is fair, just and equitable. He is represented by Jason S. Bell of Baradat & Paboojian Inc. in Fresno.
