Homeowners allege properties developed by Centex Homes have structural issues

FRESNO – Several Fresno County property owners in the Fancher Creek housing development allege that their houses were not constructed to building standards.

Guadalupe Basulto Jr., et al. filed a complaint on June 5 in the Fresno County Superior Court against Centex Homes and Does 1-500 alleging violation of building standards, breach of contract and breach of express warranty.

According to the complaint, the plaintiffs allege that they purchased their properties from the defendants on or after Jan. 1, 2003. They allege the properties have water, structural, fire protection and other issues that materially impair their use.

The plaintiffs hold Centex Homes and Does 1-500 responsible because the defendants allegedly failed to comply with the material provisions of the California Civil Code and failed to perform work in a workmanlike manner.

The plaintiffs request a trial by jury and seek costs of restoration and repairs to their properties of more than $100,000 per home, damages for the loss of use of their property and relocation expenses, costs of court and all other relief that are just and proper. They are represented by Luke P. Ryan, Lori J. Guthrie and Kevin B. Hambly of Shinnick & Ryan LLP in San Diego.
