Biola property buyers allege they have not received deed of trust after paying off contract

FRESNO – Two Biola residents allege they paid off a property but still have not received the deed of trust from the seller.

Cipriano F. De Jesus Santos and Crispina Salazar filed a complaint on June 12 in the Fresno County Superior Court against Harbans Kaur Lehra and Does 1-10 alleging breach of contract.

According to the complaint, the plaintiffs allege that on Oct. 8, 2001, they entered a contract with Lehra to purchase a Biola property for $70,000. They allege they paid off the contract in 2006 and have not received a reconveyance of the note and deed of trust.

The plaintiffs hold Lehra and Does 1-10 responsible because the defendants allegedly breached the purchase contract by failing and refusing to deliver the title of the property pursuant to the terms of the purchase contract.

The plaintiffs seek judgment against defendants for costs of suit, compensatory damages, attorney's fees and other relief as the court deems just. They are represented by Brian N. Folland of The Folland Law Group in Fresno.
