Fresno seeks more than $40,000 from owners of demolished property

FRESNO – The city of Fresno is seeking reimbursement from the owners of a property after the city demolished it after multiple code violations.

City of Fresno and People of the State of California filed a complaint on June 12 in the Fresno County Superior Court against Primitivo V. Diaz, Fermin A. Diaz and Does 1-50 alleging violation of Fresno Municipal Code.

According to the complaint, the defendants are the owners of 5240 N. State St. in Fresno. The plaintiffs allege the property has a history of municipal code violations and contained several partially demolished, fire-damaged structures. The suit states in 2017, the city determined to demolish the structure and hired contractors to conduct lead-based paint and asbestos inspections before demolition.

The city alleges it invoiced $42,801.54 to the defendants for the abatement expenses, which they have not paid.

The plaintiffs seek judgment against defendants for all costs in the amount of $42,801.54, costs of suit, and further relief as the court deems proper. They are represented by Fresno City Attorney Douglas T. Sloan and Deputy City Attorney Chad T. Snyder in Fresno.
