Woman alleges she was injured at Park West Apartments after stepping into concealed flooded hole

FRESNO – A Fresno County woman alleges she was injured when she fell in a hole at a Fresno apartment complex.

Shary Padilla filed a complaint on June 29 in the Fresno County Superior Court against Park West Apartments LLP and Does 1-10 alleging premises liability.

According to the complaint, Padilla alleges that on July 8, 2016, she was lawfully on defendant's premises walking across the grass to reach the curb area when her feet collapsed beneath her into a water sprinkler timer area, causing injuries. She alleges the hole was concealed by grass.

The plaintiff holds Park West Apartments LLP responsible because the defendant allegedly failed to inspect the premises to discover and correct or warn of anticipated dangerous conditions such as a partially covered and flooded hole on a frequently accessed walkway on the premises.

The plaintiff requests a trial by jury and seeks judgment for special and general damages and such further and other relief the court may deem just and proper. She is represented by Jason A. Helsel and Mark A. Vogt of Fowler Helsel Vogt in Fresno.
