Caregiver alleges she was terminated by Amdal In-Home Care for refusing to help dispose of cats

Wrongful term 07

FRESNO – A woman alleges she was terminated from her position as a caregiver after she refused to help a client illegally dispose of cats.

Darlene Golden filed a complaint on July 9 in the Fresno County Superior Court against Amdal In-Home Care Inc. and Does 1-50 alleging wrongful termination.

According to the complaint, the plaintiff alleges that while she was working as a full-time caregiver providing in-home care assistance to clients of the defendant in 2017, she was required by her employer-defendant to assist the daughter of a client to sedate and illegally dispose of a large number of stray cats that were causing damage to their home.

When she refused to participate in the allegedly illegal and cruel disposal of cats, she alleges the defendant retaliated against her by placing her on an on-call status and ultimately terminating her employment.

The plaintiff holds Amdal In-Home Care Inc. and Does 1-50 responsible because the defendants allegedly retaliated against employees who refused to participate in activity that would result in violation of state or federal statutes.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory, special, exemplary and punitive damages; interest; costs of suit; attorneys’ fees and expert witness fees; and further relief as the court may deem just. She is represented by Eric P. Oren of Law Offices of Eric P. Oren in Fresno.
