Man seeks rescission of sales contract of GMC vehicle because of alleged defects

FRESNO – A Fresno County consumer is seeking the rescission of the sales contract on a GMC vehicle he alleges has defects.

William Zapata filed a complaint on July 13 in the Fresno County Superior Court against General Motors LLC and Does 1-20 alleging violation of the Song-Beverly Consumer Warranty Act.

According to the complaint, the plaintiff alleges that on Feb. 24, 2016, he purchased 2015 GMC Sierra 1500 motor vehicle from one of defendants' franchise dealerships. He alleges the vehicle is defective and that he has taken it to the dealership for repairs seven times. He alleges he notified General Motors in April 2017 of the defects but the defendant has refused and/or failed to repair or replace the vehicle.

The plaintiff holds General Motors LLC and Does 1-20 responsible because the defendants allegedly failed or refused to repair the vehicle so as to bring it into conformity with the express warranties.

The plaintiff seeks judgment against defendants for incidental and consequential damages, rescission of the contract, restitution of all monies paid, exemplary damages and/or civil penalty, attorney’s fees and costs of suit, interest, and other relief as the court deems just and proper.
