LOS ANGELES – A Los Angeles corporation alleges one of its textile designs was unlawfully used in garments without its consent.
Star Fabrics Inc. filed a complaint on July 17 in the U.S. District Court for the Central District of California against National Stores Inc., Hot Ginger Inc., et al. alleging copyright infringement.
According to the complaint, the plaintiff alleges that it is the registered owner of the original two-dimensional artwork used for textile printing titled 59705.
The plaintiff holds National Stores Inc., Hot Ginger Inc., et al. responsible because the defendants allegedly manufactured and supplied garments comprised of fabric printed with plaintiff’s copyrighted design without plaintiff’s knowledge or consent.
The plaintiff requests a trial by jury and seeks award for all profits of defendants plus all losses of plaintiff, the exact sum to be proven at time of trial, attorneys’ fees, costs, prejudgment interest and such other legal and equitable relief.
