FRESNO – An insurance company alleges the negligence of company doing business in Fresno County caused property damage to its insured.
Great Lakes Reinsurance (UK) PLC filed a complaint on July 19 in the Fresno County Superior Court against Emerick Machine Sales and Does 1-10 alleging negligence and equitable subrogation.
According to the complaint, the plaintiff insured FTS Enterprises, which purchased machinery from the defendant. The suit states on July 21, 2015, the defendant delivered the machinery to FTS and dropped it, causing property damage.
The plaintiff alleges that it became obligated to its insured as a consequence of the damages to the property.
The plaintiff seeks judgment for special damages, prejudgment interest, costs of suit and such other and further relief as the court deems appropriate. It is represented by Steven B. Soltman of Soltman, Levitt, Flaherty & Wattles LLP in Thousand Oaks.
