BC Truckline sues for breach of contract

FRESNO — BC Truckline Inc., a transport company, is suing Borarai Transport Inc. and Does 1-50, citing alleged breach of contract, fraud and unjust enrichment.

Ajit Singh, who owns BC Truckline filed the complaint on July 11, in Fresno County Superior Court, alleging that the defendants defrauded his company by taking more than their "rightful portion of the full gross revenue," according to the lawsuit.

Singh alleges in the complaint that the defendants began taking more than the agreed-to five percent of the gross revenue generated for each load, starting in 2017.

Singh claimed that he demanded an accounting of -- and remittance -- of the excess. He claims that neither was provided, according to the complaint.

The plaintiff holds Borarai Transport and Does 1-50 responsible, because the defendants allegedly had exclusive control over the accounting books and documents of the business, despite demands by plaintiff.

The plaintiff requests a trial by jury and seeks judgment that exceeds $10,000 in damages for breach of contract and fraud, exemplary and punitive damages, costs of suit, and for such other and further relief as the court may deem proper.
