Accuire alleged to owe more than $400,000 to insurance company

SACRAMENTO – An insurance carrier alleges a Sacramento business owes more than $400,000.

Zurich American Insurance Co. of Illinois filed a complaint on July 28 in the U.S. District Court for the Eastern District of California against Accuire LLC and Does 1-100 alleging breach of contract

According to the complaint, the plaintiff issued a workers' compensation policy to the defendant at its request for the period of Oct. 1, 2015, to Dec. 15, 2015. After the completion of the policy period, the plaintiff sent a payroll audit to the defendant with a demand for an additional payment of $491,614 in May 2016.

The plaintiff holds Accuire LLC and Does 1-100 responsible because the defendants allegedly failed to pay plaintiff the premium adjustment amount totaling $491,614.

The plaintiff requests a trial by jury and seeks judgment in its favor and against defendants for damages in the amount of $491,614, plus interest or according to proof at trial, award of daily prejudgment interest, costs of suit, and further relief as the court may deem proper.
