FRESNO — A Home Depot customer alleges he slipped and fell on loose cement at the Highland Avenue store in Selma, after the retailer failed to warn the public about "the dangerous condition."
Gustavo Oceguera Rebolledo filed the complaint on July 23, in Fresno County Superior Court, against The Home Depot USA Inc. and Does 1-30, alleging that the retail company did not do enough to keep the public safe. He is seeking more than $25,000 in damages, according to court documents.
According to the complaint, the plaintiff alleges that on June 28, 2017, he was at the Home Depot, when he allegedly slipped and fell on the loose cement on the floor.
Plaintiff indicates that he was carrying an 80-pound sack of cement and trying to place it in his shopping cart, when he tripped and fell. Rebolledo claims he suffered serious injuries. The plaintiff holds The Home Depot USA, Inc. and Does 1 to 30 responsible, because the defendant allegedly failed to placed "warning signs" on the floor.
"Plaintiff fell on top of the cart and sustained injuries to his back, neck,head, right leg, right foot, left foot, right ankle, right knee, right hand and right arm," according to the lawsuit.
The plaintiff requests a trial by jury and seeks judgment for compensatory damages according to proof, costs of suit, and such relief as is fair, just and equitable. He is represented by David O. Hernandez of Hernandez Law Offices in Fresno.
