FRESNO – A shopper at an Atwater store alleges that she was not warned of water on the floor that caused her to fall.
Firacelia Lyons filed a complaint on Aug. 6 in the Fresno County Superior Court against Fairway Supermarket, doing business as Food 4 Less, and Does 1-30 alleging negligence.
According to the complaint, the plaintiff alleges that on Aug. 9, 2016, she was on the premises of defendant's store located at 2840 Shaffer Road in Atwater and slipped and fell due to a puddle of water on the floor. The suit states the water was near an ice machine and that there was not posted warning signs or mats on the floor.
The plaintiff holds Fairway Supermarket and Does 1-30 responsible because the defendants allegedly failed to properly inspect and maintain the source of the allegedly dangerous condition.
The plaintiff seeks judgment against defendant for compensatory damages according to proof. She is represented by Ronald D. Smith of Office of Ronald D. Smith in Fresno.
