Dynamic Marketing alleges individual unlawfully terminated agreement

FRESNO – A Lake Forest business alleges a Fresno County individual wrongfully terminated an agreement without cause.

Dynamic Marketing Inc., doing business as DMI Direct, filed a complaint on Aug. 3 in the Fresno County Superior Court against Elizabeth Heng alleging breach of contract.

According to the complaint, the plaintiff alleges that on Feb. 15, it and the defendant entered into a contract. The suit states in June, the defendant terminated the agreement without cause in breach of the agreement. The plaintiff alleges the agreement does not allow for termination without cause.

The plaintiff holds Heng responsible because the defendant allegedly has no cause to terminate the agreement and failed to make a $7,500 payment due in July. 

The plaintiff seeks judgment against defendant for award of compensatory damages, attorneys’ fees, costs and necessary disbursements, costs and such other and further relief as the court deems just. It is represented by Daniel F. Lula of Payne & Fears LLP in Irvine.
