Chevrolet Cruze owner alleges vehicle has defects and seeks restitution

FRESNO – A Fresno consumer alleges a Chevrolet vehicle she purchased has engine overheating issues and is seeking restitution.

Alisha Camero filed a complaint on Aug. 2 in the Fresno County Superior Court of the State of California against General Motors LLC, Michael Cadillac Inc., doing business as Michael Automotive Center, and Does 1-10 alleging violation of the Song-Beverly Consumer Warranty Act.

According to the complaint, the plaintiff alleges that on Dec. 14, 2014, she purchased a new 2014 Chevrolet Cruze from Michael Automotive Center. She alleges the vehicle has an engine coolant leak, inoperable turbo and battery, issues with engine overheating and other defects that have impaired the vehicle's use, value and safety.

The plaintiff alleges the defendants have failed to repair the vehicle despite multiple attempts.

The plaintiff holds General Motors LLC, Michael Cadillac Inc. and Does 1-10 responsible because the defendant allegedly failed to repair the vehicle’s defects and/or nonconformities under the express warranty.

The plaintiff requests a trial by jury and seeks judgment against defendants for general, special and actual damages; restitution; incidental and consequential damages; civil penalty; interest; attorney's fees; costs; and further relief as the court deems just.
