Fresno County homeowners allege Lannar Fresno homes have defects

FRESNO – Several Fresno County homeowners have filed suit against a contractor/developer over allegations that the homes have defects.

Stacey Baxter; Robert McGurty and Angela Hill; Vincent P. and Carole K. Bence, et al. filed a complaint on Aug. 3 in the Fresno County Superior Court against Lennar Fresno Inc. and Does 1-1,000 alleging breach of contract, violation of building standards and other counts.

According to the complaint, on Jan. 1, 2003, the plaintiffs purchased properties constructed and/or developed by defendant and allege the properties were defective and unfit for their intended purposes.

The plaintiffs also claim the defects were not apparent by reasonable inspection of the property at the time of the purchase and the defects thereafter manifested. 

The plaintiffs hold Lennar Fresno Inc. and Does 1-1,000 responsible because the defendants allegedly breached the sales contracts failing to provide residences constructed in a workmanlike manner.

The plaintiffs seek judgment for costs of restoration and repair to the property of more than $50,000 per home, costs of investigation, expert fees, relocation expenses and such other and further relief as the court deems just and proper. They are represented by Miguel Iniguez of Milstein Jackson Fairchild & Wade LLP in Los Angeles.
