SAN DIEGO – A San Diego County woman alleges she is disabled and that an insurance company wrongfully denied her claim for long-term disability benefits.
Denise Barone filed a complaint on Aug. 8 in the U.S. District Court for the Southern District of California against Liberty Life Assurance Co. of Boston citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff became disabled in April 2016 and remains disabled because of chronic pain syndrome with fibromyalgia and other medical issues. She alleges she made a claim with the defendant for long-term disability benefits and was denied in December 2016.
The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly wrongfully denied disability benefits.
The plaintiff seeks judgment against defendant for declaratory relief, attorney's fees, costs of suit and further relief as the court may deem proper. She is represented by John P. Stennett and Barbara A. Casino of Stennett & Casino in San Diego.
