LOS ANGELES – A Los Angeles County man alleges he was turned down for a job because of his disability.
Cetera Chisolm filed a complaint on Aug. 16 in the U.S. District Court for the Central District of California against Enterprise Rent-A-Car Co. of Los Angeles; Alamo Rental (US) LLC and Does 1-50 alleging discrimination on the basis of disability and other counts.
According to the complaint, the plaintiff has worked as a commercial driver for several years. The suit states he injured his right hand in 2014, which decreased some use of his hand, but he is still able to grip and pull items with it.
The suit states he applied for a job with Alamo Rental in December 2017 as an airport shuttle driver and had two interviews in January. He alleges he was contacted in February by Enterprise, who handled human resources for Alamo, and was told that it could not offer him the airport shuttle driver position because it was concerned that he could not safely operate the airport shuttle vehicle.
The plaintiff holds Enterprise Rent-A-Car Co. of Los Angeles, Alamo Rental (US) LLC and Does 1-50 responsible because the defendants allegedly refused to hire plaintiff due to his actual and/or perceived disability.
The plaintiff requests a trial by jury and seeks judgment for declaratory judgment, damages, pre- and post-judgment interest, and grant such other and further relief as it may be just and proper. He is represented by Gary R. Carlin, Brent S. Buchsbaum and Roger Haag of Law Offices of Carlin & Buchsbaum LLP in Long Beach.
