Wheelchair user alleges Bea's Bakery in Tarzana did not have compliant parking

LOS ANGELES – A Tarzana bakery is alleged to have failed to maintain parking for customers with disabilities.

Nicholas Hopewell filed a complaint on Aug. 16 in the U.S. District Court for the Central District of California against SBL Corp., doing business as Bea's Bakery, and Does 1-10 alleging that they violated the Americans with Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, the plaintiff has a physical disability and uses a wheelchair when traveling in public.

He alleges that on May 13 and July 5, he went to defendants' business and personally encountered barriers that interfered with his ability to use and enjoy the goods, services and accommodations offered therein. 

The plaintiff holds SBL Corp. and Does 1-10 responsible because the defendants allegedly failed to maintain the parking space designated for persons with disabilities and failed to provide the access aisles with leveled surface slopes.

The plaintiff requests a trial by jury and seeks an order directing defendants to comply with the Acts, and award for damages, attorney’s fees, litigation expenses and costs and such other just and proper relief. He is represented by Jason Yoon, John Y. Kim and Jason J. Kim of So. Cal. Equal Access Group in Los Angeles.
