Buyer alleges Chevrolet Volt has defects, seeks rescission of contract

FRESNO – A Fresno consumer alleges a General Motors vehicle he purchased in 2017 has defects and is seeking rescission of the purchase contract.

Ramiro Berumen Mejia filed a complaint on Aug. 20 in the Fresno County Superior Court against General Motors LLC and Does 1 through 10 over alleged violation of the Song-Beverly Consumer Warranty Act.

According to the complaint, on March 20, 2017, Berumen purchased a used 2014 Chevrolet Volt and that express warranties accompanied the sale of the vehicle. He alleges the vehicle was delivered with serious defects and nonconformities with the transmission, electrical, suspension and engine.

Furthermore, he alleges the defendants were unable to conform the vehicle to the applicable express warranties after a reasonable number of repair attempts. 

The plaintiff holds General Motors LLC responsible because the defendant allegedly failed to remedy the defects or to issue a refund and failed to either promptly replace the used motor vehicle or to promptly make restitution in accordance with the Song-Beverly Act.

The plaintiff seeks judgment for general, special and actual damages; rescission of the purchase contract; diminution in value, and civil penalty in the amount of two times plaintiff's actual damages. He is represented by Steve Mikhov and Amy Morse of Knight Law Group LLP in Los Angeles.
