FRESNO — A Kern County, California, resident is suing General Motors claiming her new 2017 GMC Acadia was defective and not in suitable condition to drive.
She is citing alleged breach of implied and express warranties.
Parwinder P. Parmar filed a complaint on Aug. 17, in the Fresno County Superior Court against General Motors LLC; and Does 1 through 100 for alleged violations of the Magnuson–Moss Warranty Act.
According to the complaint, on Feb. 17, 2017, Parwinder P. Parmar purchased a new 2017 GMC Acadia from GM, provided with express written warranty relating to the vehicle.
However, plaintiff claims the delivered vehicle was not in a condition for sale, was not safe, and did not meet the quality and safety guidelines reasonably expected of a motor vehicle.
Parmar claims the vehicle is useless due to the frequency of breakdowns, the safety hazards and the amount of time the vehicle was out of service due to repair attempts.
The plaintiff holds GM responsible because the defendant allegedly failed to repair the defects or to replace the vehicle.
The plaintiff requests a trial by jury and seeks judgment for incidental and consequential damages, rescission of the purchase agreement, attorney's fees, civil penalty, costs of suit, pre-judgment interest, and other relief the court deems proper.
