Sacor Financial Inc., Roseville law firm alleged to have unlawfully communicated with woman about late father's debt

LOS ANGELES – A Los Angeles County consumer alleges a Roseville law firm continues to communicate with her regarding a debt she refuses to pay.

Jessica J. Gallant filed a complaint on Aug. 18 in the U.S. District Court for the Central District of California against Sacor Financial Inc., Law Offices of Joseph W. Scalia APC and Joseph W. Scalia citing the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff's father had a credit card with MBNA America and was behind on his bills before his death in 2014. She alleges she was not a cardholder, authorized user or co-signer for the MBNA account.

The suit states Joseph W. Scalia APC is representing Sacor in the collection of the MBNA debt. The plaintiff alleges she disputed the debt in 2012 and again in May 2018 and refused to pay it, but the defendants continued to communicate with her about the alleged debt.

The plaintiff holds Sacor Financial Inc., Law Offices of Joseph W. Scalia APC and Scalia responsible because the defendants allegedly unlawfully communicated with the plaintiff after they were informed the plaintiff refused to pay it.

The plaintiff requests a trial by jury and seeks judgment against defendants, award of actual and statutory damages, costs of litigation, attorney's fees and further relief as may be just. She is represented by Michael F. Cardoza of The Cardoza Law Corp. in San Francisco.
