LOS ANGELES – A woman alleges she was wrongfully denied $110,000 in life insurance benefits.
Rebecca Reutter, individually and as trustee of the Kirk Reutter Family Trust, filed a complaint on Aug. 27 in the U.S. District Court for the Central District of California against Hartford Life Insurance Co., Omnicare Inc. and CVSHealth citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff's brother, Kirk Reutter, was formerly an employee of Omnicare, later acquired by CVSHealth, and named her as a beneficiary of his group life insurance coverage issued by Hartford.
The suit states Kirk Reutter died of pancreatic cancer in July 2017 and the plaintiff made a claim to Hartford for life insurance benefits under the Omnicare Plan, to which defendant Hartford denied and insisted that the decedent did not have coverage in force at the time of his death. She alleges this decision was in error and she provided a copy of the confirmation to the defendants. She alleges the defendants haven't responded.
The plaintiff holds Hartford Life Insurance Co., Omnicare Inc. and CVSHealth responsible because the defendants allegedly wrongfully denied the benefits due to her.
The plaintiff requests a trial by jury and seeks relief against defendants, payment of of life insurance benefits. She is represented by Alan E. Kassan, Glenn R. Kantor and Mitch O. Hefter of Kantor & Kantor LLP in Northridge.
