Kasiner Farms alleged to owe more than $500,000 to Simplot Grower Solutions

FRESNO – A food and agriculture company alleges a farm owes more than $500,000 for goods it purchased.

J.R. Simplot Co., doing business as Simplot Grower Solutions, filed a complaint on Aug. 22 in the Fresno County Superior Court against Kasiner Farms Inc. and Does 1 to 50 alleging breach of contract.

According to the complaint, on March 30, 2014, the plaintiff agreed to furnish goods and services on account to defendant for which defendant agreed to pay for the said goods and services. 

The plaintiff alleges that despite performing its duties, the company has not received payment due and owing from the defendant in the principal sum of of $538,936.95, together with accrued finance charges in the amount of $71,817.19 up to and including July 28, plus finance charges in the amount of $265.77 per day from and after July 28. 

The plaintiff seeks judgment for damages in the principal amount of $538,936.95 together with interests, attorney fees according to proof and accrued finance charges. It is represented by Brett T. Abbott of Gubler & Abbott in Visalia.
