SACRAMENTO – A consumer alleges inaccurate information is listed on her credit report.
Jean Flaherty filed a complaint on Aug. 29 in the U.S. District Court for the Eastern District of California Sacramento Division against Equifax Information Services LLC and OneMain Financial Services Inc. alleging violation of the Fair Credit Reporting Act.
According to the complaint, the plaintiff filed for Chapter 7 bankruptcy protection in July 2017. She alleges in April, she ordered a three-bureau credit report and found inaccurate information, including a OneMain trade line that was reported as charged off instead of discharged in bankruptcy. She alleges she disputed the information and the information has not been updated.
The plaintiff holds Equifax Information Services LLC and OneMain Financial Services Inc. responsible because the defendants allegedly failed to establish and/or follow procedures to assure maximum possibly accuracy and/or failed to conduct a reasonable investigation.
The plaintiff requests a trial by jury and seeks judgment against defendant for injunctive relief; award statutory, actual and punitive damages; attorney’s fees; and costs of suit.
