Hiland Dairy Foods allege Brisa Goods owes more than $3 million on note

SAN DIEGO – A company organized under Illinois law alleges that it is still owed millions on a promissory note from a company.

Hiland Dairy Foods Co. LLC filed a complaint on Aug. 28 in the U.S. District Court for the Southern District of California against Brisa Goods LLC and Does 1-15 alleging breach of corporate guaranty.

According to the complaint, the plaintiff alleges that on Feb. 19, 2016, the defendant's managing member Francisco Xavier Bou Claisse issued a promissory note on behalf of Brisagoods de Monterrey, SA to plaintiff for $4 million. After receiving payments totaling $850,000, the plaintiff alleges the principal amount of $3.15 million remains outstanding. 

The plaintiff holds Brisa Goods LLC and Does 1-15 responsible because in spite demand for payments, the defendants allegedly failed and refuses to do so.

The plaintiff seeks actual and compensatory damages in the amount of $3.15 million, plus interest, attorneys' fees, costs and such other just and proper relief. It is represented by Bradford G. Hughes and Tiffany B. Hunter of Clark Hill LLP in Los Angeles.
