Helix Environmental Planning accuses Helix Environmental and Strategic Solutions of infringement

SAN DIEGO – A La Mesa business alleges a Porter Ranch company is infringing its trade name.

Helix Environmental Planning Inc. filed a complaint on Aug. 27 in the U.S. District Court for the Southern District of California against Helix Environmental and Strategic Solutions alleging service mark and trade name infringement and other counts.

According to the complaint, the plaintiff has been using its service mark and trade name since 1991 and the service mark has been registered with the U.S. Patent and Trademark Office. The suit states the defendant began using the Helix Environmental name in 2016.

The plaintiff alleges that the similar name and services offered by the defendant are likely to cause confusion among consumers and the defendant's unauthorized use of the term Helix Environmental deprives it of the ability to control the quality of the services marketed under that name.

The plaintiff requests a trial by jury and seeks judgment for treble actual damages, attorneys' fees, litigation costs, expenses, and for such additional, other, or further relief as the court deems just and proper. It is represented by Gary L. Eastman of Eastman & McCartney LLP in San Diego.
