SACRAMENTO – A Visalia resident alleges a Texas-based debt collector left a voicemail message and unlawfully failed to identify the nature of the call.
Bill Dolan filed a complaint on Sept. 6 in the U.S. District Court for the Eastern District of California against GC Services LP alleging violation of the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that beginning in August 2017, the defendant began calling him to collect an alleged debt. The suit states on Sept. 27, 2017, the defendant left a voicemail message on plaintiff's answering machine and failed to disclose the company name, nature of the call or state that call was from a debt collector.
The plaintiff holds GC Services LP responsible because the defendant allegedly used false, deceptive and misleading means it connection with its debt collection practices but not identifying the purpose of its phone calls.
The plaintiff requests a trial by jury and seeks judgment against defendant for statutory and compensatory damages, attorneys’ fees, costs and other relief that the court deems appropriate. He is represented by attorney Ibrahim Muhtaseb in Murrieta.
