SAN DIEGO – A San Diego County consumer alleges a debt collector contacted her without her consent.

Ophelia Augustine filed a complaint on Sept. 12 in the U.S. District Court for the Southern District of California against Lien Enforcement Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on July 20, the defendant left a voicemail on her cellphone made through the use of an automatic telephone dialing system. 

The plaintiff holds Lien Enforcement Inc. responsible because the defendant allegedly used an ATDS and prerecorded voice to contact her without her consent.

The plaintiff requests a trial by jury and seeks judgment for statutory and treble damages, injunctive relief and any other relief the court may deem just and proper. She is represented by Joshua B. Swigart and Yana A. Hart of Hyde & Swigart APC in San Diego.
