Clovis couple seeks more than $400,000 from developers over home damage

FRESNO – A Clovis couple alleges that construction work near their property caused flooding.

John Baldwin and Patricia Baldwin filed a complaint on Sept. 6 in the Fresno County Superior Court against Wathen Castanos Peterson Homes Inc., WC Clovis 5720A and Does 1-25 alleging negligence, trespass, nuisance and financial elder abuse.

According to the complaint, the plaintiffs reside on a property in Clovis and that the defendants are developing a subdivision adjacent to their property.

The suit states on Feb. 3, 2017, the plaintiff's property was flooded by mud and water during a rain storm and the damage rendered the home unfit to live in. 

The plaintiffs holds Wathen Castanos Peters Homes Inc., WC Clovis 5720A and Does 1-25 responsible because the defendants allegedly breached their duty by failing to take care in developing and construction on the adjacent land and damaging the plaintiffs' property.

The plaintiffs seek judgment for damages, costs of repair and reimbursement for out-of-pocket expenses of more than $400,000, prejudgment interest, attorney's fees, costs of suit, and for such other and further relief as the court deem just and proper.
