Employee files disability discrimination suit against California Department of Rehabilitation

FRESNO – A woman alleges she was subjected to adverse employment actions from her state employer because of her disability.

Sheila Dibaji filed a complaint on Sept. 1 in the Fresno County Superior Court against State of California Department of Rehabilitation and Does 1-50 alleging disability discrimination.

According to the complaint, the plaintiff began her employment with the defendant in 1997 as a rehabilitation counselor for the deaf and has been promoted to other positions. The suit states the plaintiff is also hearing-impaired. She alleges she was subjected to adverse employment actions, including a denial of reasonable accommodation and demotion, because of her disability.

The plaintiff holds State of California Department of Rehabilitation and Does 1-50 responsible because the defendants allegedly unlawfully harassed her because of her disability and that her disability was a motivating reason to deny her reasonable accommodations.

The plaintiff seeks judgment against defendant for compensatory damages, attorneys' fees and costs, costs of suit and other penalties. She is represented by Lawrance A. Bohm, Junn O. Paulino and Andrew C. Kim of Bohm Law Group Inc. in Sacramento.
