Inaccurate information on credit report from Ditech Financial damaged credit, man alleges

SACRAMENTO – A Vallejo consumer alleges his creditworthiness has been damaged because of inaccurate information on his credit score.

Joshua Kraus filed a complaint on Sept. 17 in the U.S. District Court for the Eastern District of California against Ditech Financial LLC, Experian Information Solutions Inc. and Equifax Information Services LLC alleging violation of the Fair Credit Reporting Act and the California Consumer Credit Reporting Agencies Act.

According to the complaint, the plaintiff alleges that the defendants are reporting erroneous negative and derogatory reports on his credit report. He alleges he filed for bankruptcy in 2012 and it was successfully discharged in 2016, but Ditech is reporting inaccurate information about the bankruptcy on his credit reports.

The plaintiff holds Ditech Financial LLC, Experian Information Solutions Inc. and Equifax Information Services LLC responsible because the defendants allegedly willfully and negligently fail to properly investigate his disputes concerning the inaccurate data.

The plaintiff requests a trial by jury and seeks judgment against defendants, award of actual and punitive damages, costs, attorneys' fees, equitable and injunctive relief, and all other relief the court deems just and proper.
