Rash Curtis & Associates alleged to have attempted to collect unauthorized fee from consumer

SACRAMENTO – A Placerville consumer alleges a Vacaville debt collector attempted to collect an unlawful fee.

Laura Ellen Goodwin filed a complaint on Sept. 18 in the U.S. District Court for the Eastern District of California against Rash Curtis & Associates alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that the defendant contacted her in an attempt to collect an alleged debt. She alleges on May 10, she offered to satisfy multiple outstanding balances for $649.09 that all originated from the same creditor. The suit states that the defendant told the plaintiff that in order to process her request sooner, she would need to pay a $25 expedite fee. She alleges this fee is impermissible.

The plaintiff holds Rash Curtis & Associates responsible because the defendant allegedly used unfair and unconscionable means to collect or attempt to collect a debt and attempted to collect an amount from plaintiff that was unauthorized by agreement or law.

The plaintiff requests a trial by jury and seeks judgment against defendant for actual, statutory and punitive damages, costs of litigation, attorney's fees, and further relief as the court deems just. She is represented by Trinette G. Kent of Lemberg Law LLC in Phoenix, Arizona.
