Parcel Pending alleged to have failed to disclose it recorded calls

SAN DIEGO – A consumer alleges that a debt collector failed to inform him that it was recording their calls.

Jayson Swigart filed a complaint on behalf of individually and on behalf of all others similarly situated on Sept. 26 in the U.S. District Court for the Southern District of California against Parcel Pending Inc. alleging violation of the California Invasion of Privacy Act.

According to the complaint, the plaintiff alleges that he and the defendant spoke multiple times over the phone in July and that during the course of their conversations, it was not disclosed that the defendant was recording the calls.

The plaintiff holds Parcel Pending Inc. responsible because the defendant allegedly failed to obtain plaintiff's consent to be monitored, recorded and/or eavesdropped upon.

The plaintiff requests a trial by jury and seeks judgment against defendants, certify class action, injunctive relief, costs of suit, interest and further relief as the court deems just.
