Convention Electrical Services alleged to have failed to pay union contributions

SAN DIEGO – An electrical services provider is alleged to have failed to pay an amount found due and owing to union benefit funds.

Board of Trustees of the San Diego Electrical Pension Trust; Board of Trustees of the San Diego Electrical Health & Welfare Trust; Andy Berg and Andrew McKercher filed a complaint on Sept. 27 in the U.S. District Court for the Southern District of California against Convention Electric Inc., doing business as Convention Electrical Services over alleged violation of the Employee Retirement Income Security Act.

According to the complaint, the defendant entered into a bargaining agreement with I.B.E.W. Local Union 569 that requires it to submit employer contributions to the plaintiff funds.

The plaintiffs hold Convention Electric Inc. responsible because the defendant allegedly failed to pay the amounts found due from an audit of its payroll records from Jan. 1, 2013, to Dec. 31, 2017.

The plaintiffs request a trial by jury and seek judgment for unpaid contributions, liquidated damages, interests on all late-paid and unpaid contributions, attorneys' fees, costs of action and such other and further relief as the court may deem just and proper. They are represented by Michele R. Stafford and Tino X. Do of Saltzman & Johnson Law Corp. in Alameda.
