Insurance company alleges minor child is responsible for property fire, seeks more than $250,000

FRESNO – An insurance company is seeking reimbursement from a mother over allegations her minor child caused a property fire.

California Capital Insurance Co. filed a complaint on Sept. 25 in the Fresno County Superior Court against Molly Davis and Does 1-20 seeking insurance subrogation.

According to the complaint, the plaintiff alleges that on Jan. 2, 2017, plaintiff's insureds' property at 72 W. San Gabriel Ave. in Clovis sustained extensive damage due to a fire that was caused by defendant Davis' minor child and a candle. The plaintiff alleges was obligated to pay its insureds, Lester & Norma Bewley, the sum of $278,196.73. 

The plaintiff holds Davis and Does 1-20 responsible because Davis allegedly failed to exercise reasonable care to prevent her minor child's conduct.

The plaintiff seeks reimbursement of the paid damages plus interest at the legal rate. It is represented by Amanda R. Stevens of Schroeder Loscotoff LLP in Sacramento.
