FRESNO – A California corporation alleges it is owed more than $30,000 for produce that was delivered to it in a damaged condition.
BC Fruta Inc. filed a complaint on Sept. 25 in the Fresno County Superior Court of the State of California against FreshKO Produce Services Inc., doing business as FreshKO Produce and Disband Produce, and Does 1-10 alleging breach of contract.
According to the complaint, the plaintiff entered into an agreement with the defendants for the pickup, transportation and delivery of produce provided by the defendants for the plaintiff. The plaintiff alleges the produce was decayed and damaged upon arrival and that the defendant was proven to owe a balance to the plaintiff.
The plaintiff seeks judgment against the defendant for damages in the amount of $30,409.50 plus interest of 10 percent per year, and other relief as the court may deem just. It is represented by Alexander V. Hettena of the Hettena Law Firm in Westlake Village.
