TD Bank USA alleges individual failed to pay credit card balance

STOCKTON – A bank alleges it is owed more than $1,000 on a credit card account from an individual residing in the state.

TD Bank USA, NA filed a complaint on Oct. 4 in the San Joaquin Superior Court against Marcus Allan Trujillo and Does 1 through 10 alleging failure to pay.

According to the complaint, the plaintiff alleges the last payment it received from the defendant on a credit card account was May 20, 2017. It alleges the account's balance at the time of charge off was $1,014.37.

The plaintiff holds Trujillo and Does 1 through 10 responsible because the defendant allegedly failed to satisfy the balance due despite demand for repayment.

The plaintiff seeks judgment for unpaid balance of $1,014.37, plus costs of suit, and such other relief as the court may deem just and proper. It is represented by Mishaela J. Kirkpatrick and Karen Etsell Lusis of Raush Sturm in San Diego.
