Former Saigon Unphogettabowl employee alleges she was discriminated against because of disability

SAN JOAQUIN – A Manteca restaurant is alleged to have wrongfully terminated a woman after she complained of being harassed due to her disability.

Julie Cervantes filed a complaint on Oct. 5 in the San Joaquin Superior Court against NLN Bro Inc., doing business as Saigon Unphogettabowl, and Does 1-100 alleging violation of California Labor Code.

According to the complaint, the plaintiff is a former employee of the defendant and was employed from April to November 2017. She alleges she was regularly harassed because of her rheumatoid arthritis and discriminated against because of her disability. She alleges she was wrongfully terminated because of her complaints of harassment.

The plaintiff holds NLN Bro Inc. and Does 1-100 responsible because the defendants allegedly discriminated against her as well as failed to compensate her for all hours worked, failed to provide mandatory rest and meal break periods, and failed to provide her with compliant and accurate itemized wage statements.

The plaintiff requests a trial by jury and seeks judgment against defendants for compensatory, special and general damages; restitution of all monies; waiting time penalties; interest; costs; disbursements; attorneys' fees; and further relief as the court deems just. She is represented by W. Zev Abramson, Nissim Levin, Christina Begakis and LaRita Turner of Abramson Labor Group in Los Angeles.
