Plumbing company sued for outstanding balance on credit account

FRESNO — An industrial supplies distributor is suing a plumbing company, citing alleged breach of contract.

Hajoca Corp. filed a complaint on Oct. 1, in the Fresno County Superior Court, against John Mastro Plumbing  Inc., John V. Mastro and Does 1 to 10, alleging that the defendants breached the agreement by failing to pay for goods, wares and merchandise which had been provided on credit, at their special instance and request.

According to the complaint, on March 1, 2004, Hajoca Corp. entered into a written agreement with defendants wherein they provided goods, wares and merchandise. 

However, plaintiff claims despite demands, defendants allegedly had an outstanding balance owed of $77,030.04 plus prejudgment interest at the rate of 12 percent from June 20. 

The plaintiff holds John Mastro Plumbing Inc., John V. Mastro and Does 1 to 10 responsible because the defendants allegedly failed and refused to pay all of any part of the amount due plus interest.

The plaintiff requests a trial by jury and seeks judgment for the principal sum of $77,030.04 with interest, attorneys fees, cost of suit, and such other and further relief as the court may deem just and proper. They are represented by Gary A. Bemis of Law Offices of Gary A. Bemis in Riverside.
