Man alleges inadequate lighting at Village at Ninth Apartments contributed to fall

FRESNO – A man alleges he was injured at an apartment complex because the conditions there caused him to fall down two steps.

Jamie Sapien filed a complaint on Oct. 9 in the Fresno County Superior Court against Village at Ninth Apartments, Village Housing Partners LP and Does 1 to 30 alleging general negligence and premises liability.

According to the complaint, on Nov. 14, 2016, Sapien was injured at defendants' apartment when he allegedly missed two steps of the stairs, causing him to fall forward. 

The plaintiff alleges it was very dark as he was walking down the stairs and the stair handle was loose and wiggled, which caused him to lose his balance and fall.

He alleges he suffered injuries to his back, neck, right arm, left shoulder and other parts of his body as a result of the fall.

The plaintiff holds Village at Ninth Apartments, Village Housing Partners LP and Does 1 to 30 responsible because the defendants allegedly failed to properly repair the stair handrail and failed to provide adequate lighting.

The plaintiff seeks judgment for compensatory damages according to proof. He is represented by David O. Hernandez of Hernandez Law Offices in Fresno.
