Buyers of The Pita Pit Willow allegedly failed to pay amount due under agreement

FRESNO – A Fresno individual alleges buyers of business failed to honor contract.

Satnam Brar filed a complaint on Oct. 11 in the Fresno County Superior Court against Mario Esquivel, Alma Santillian and Does 1 through 35 alleging breach of written contract.

According to the complaint, on Dec. 5, 2011, as a seller, Satnam Brar entered in an agreement with Esquivel in selling The Pita Pit Willow business in a loan financed in the amount of $90,000 with a fixed interest rate of 5.28 percent with monthly rent payments in the amount of $966.99. 

The plaintiff claims he performed all conditions, covenants and terms of the contract, even extending a credit line, but allegedly has received no payment from Esquivel. 

The plaintiff holds Esquivel, Santillian and Does 1 through 35 responsible because Esquivel allegedly refuses to pay the amount due under the under the agreement.

The plaintiff seeks judgment for damages, prejudgment interest, costs of suit, and such other and further relief as the court may deem just and proper. He is represented by C. Frederick Meine III of Coleman & Horowitt LLP in Fresno.
