Allstate Northbrook Indemnity seeks subrogation from Chico, business over tree damages

OROVILLE – An insurance company is seeking more than $10,000 from the city of Chico and a business for damages a tree allegedly caused to a vehicle.

Allstate Northbrook Indemnity Co., as subrogee of Meghan Linares, filed a complaint on Oct. 31 in the Butte Superior Court against Italian Cottage Inc., the city of Chico and Does 1 to 15 alleging negligence and premises liability.

According to the complaint, on June 30, Linares' motor vehicle was parked on Esplanade in Chico when a tree maintained by the defendants fell on the vehicle.

The plaintiff alleges it is entitled to subrogation for the sum of the payments made to Linares.

The plaintiff seeks judgment for compensatory damages in the amount of $11,167.22 plus prejudgment interest, and costs. It is represented by Robert Pfenning of Law Offices of Gregory Lucett in Glendale.
