STOCKTON – A landlord alleges the tenants at a Manteca property have failed to pay rent and failed to vacate the premises.

Excel Manteca LP filed a complaint on Oct. 29 in the San Joaquin Superior Court against Edgar Dominguez and Meghan Moore, individually and doing business as LifeStyle Supplements, and Does 1 through 20 alleging unlawful detainer.

According to the complaint, on Sept. 21, 2015, Excel Manteca LP leased to the defendants the premises on Daniels Street in Manteca. The suit states the defendants have failed to pay rent and as of Oct. 22, $46,410 is due and owing. The plaintiff alleges it sent a notice to quit or pay, but the defendants are still at the premises and not have paid the balance due.

The plaintiff seeks unpaid rent and related charges due plus restitution, forfeiture of the lease, damages, interest, attorneys' fees and for such other and further relief as the court deems just and proper. It is represented by Gerry C. Schmelter and Megan C. Rutkowski of Blackmar, Principe & Schmelter APC in San Diego.
