STOCKTON – A Walmart shopper is seeking damages over alleged injuries he sustained when an item fell on his head.
Mario Gutierrez filed a complaint on Oct. 29 in the San Joaquin Superior Court against Walmart Inc. alleging negligence.
According to the complaint, on Nov. 13, 2016, Gutierrez sustained injuries while shopping in defendant's store in Manteca when a heavy box containing a closet organizer fell on his head. As a result, the plaintiff alleges he sustained physical injuries and incurred hospital and medical expenses.
The plaintiff holds Walmart Inc. responsible because the defendant allegedly failed to properly stock their shelves in a manner where heavy objects cannot fall on a customer's head.
The plaintiff requests a jury trial and seeks compensatory damages in the amount of $25,000, plus costs of suit, and for such relief as is fair, just and equitable. He is represented by Steven L. Mazza of Carpenter, Zuckerman & Rowley LLP in Beverly Hills.
