FRESNO – A Fresno County consumer alleges a dealership in the county failed to inform him the vehicle he purchased was improperly lowered.
Michael Ward filed a complaint on Oct. 16 in the Fresno County Superior Court against Rsidhu Auto Group Inc., Santander Consumer USA Inc., The Western Surety Co. and Does 1-50 alleging fraudulent misrepresentation and other counts.
According to the complaint, on Jan. 19 the plaintiff purchased a 2015 Cadillac Escalade from Rsidhu Auto Group for a total price of $86,797. He alleges he later took the vehicle to an authorized Cadillac dealership and learned it had been improperly lowered through spring cutting and the electrical connections in the struts had been damaged. He also alleges that he learned the vehicle had been in several collisions and the dealership did not perform a pre-sale safety inspection.
He alleges he attempted to return the vehicle and is now demanding rescission.
The plaintiff holds Rsidhu Auto Group Inc., Santander Consumer USA Inc., The Western Surety Co. and Does 1-50 responsible because Rsidhu Auto Group allegedly misrepresented the condition of the vehicle.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages, restitution and rescission of the purchase contract, incidental and consequential damages, punitive and statutory damages and penalties, prejudgment interest, attorney's fees, costs of suit, and further relief as the court deems just.
