Shopper alleges she was injured when Walmart employee struck her with fence

FRESNO – A Walmart customer alleges she was injured by a store employee's actions in 2016.

Ana D. Malta filed a complaint on Oct. 15 in the Fresno County Superior Court against Walmart Inc. alleging general negligence and premises liability.

According to the complaint, the plaintiff alleges that on Nov. 23, 2016, she was lawfully at defendant's premises located at 7065 N. Ingram Ave. in Fresno when she was struck by a metal fence/rail that was being pushed by a store employee. As a result of the alleged negligence of an employee of the defendant, the plaintiff alleges she suffered serious physical and emotional injuries and damages, loss of wages, loss of earning capacity and incurred medical expenses. 

The plaintiff holds Walmart Inc. responsible because the defendant allegedly failed to adequately inspect, maintain and control the premises, failed to remedy the dangerous condition, and failed to provide adequate warning of the dangerous condition.

The plaintiff seeks judgment against defendant for compensatory damages according to proof. She is represented by Lee C. Arter of Law Offices of Lee C. Arter in Los Angeles.
