SAN FRANCISCO – A passenger on a Golden Gate Transit bus alleges she sustained head injuries when another passenger fell on her.
Elizabeth Duffy filed a complaint on Oct. 31 in the San Francisco Superior Court against Golden Gate Transit and Does 1-10 alleging negligence.
According to the complaint, on June 13, Duffy was passenger of defendant Golden Gate Transit as it traveled on Highway 1 in San Francisco and was allegedly injured when defendant's bus driver collided with another vehicle.
The plaintiff alleges a male passenger who was still searching for his seat suddenly fell on top her when the bus driver slammed on the brakes before colliding with the vehicle. She alleges the passenger's fall on her caused her to smash her head into the hard seat cover in front of her, wrenching the ligaments and muscles in her neck, back and shoulders.
The plaintiff holds Golden Gate Transit responsible because the defendant allegedly operated the bus in unsafe and reckless manner as the driver did not wait for the male passenger to locate a seat before accelerating and driving.
The plaintiff seeks judgment for compensatory damages. She is represented by Robert C. Strickland of Strickland Law Group PLC in Petaluma.
